Where, in the territory of a Party to the conflict, the latter is satisfied that an individual protected person is definitely suspected of or engaged in activities hostile to the security of the State, such individual person shall not be entitled to claim such rights and privileges under the present Convention.
There were no civilians present when the air strike took place. If anyone has done the German soldiers a disservice it has been the German Parliament by refusing to recognize the war in Afghanistan as such. Forbidding your soldiers to aggressively pursue the enemy places all NATO soldiers in jeopardy.
