Australian killed by train after Oktoberfest visit

A drunken Australian man visiting Munich’s Oktoberfest died early on Monday after being hit by an S-Bahn commuter train, according to the police.

The still unidentified victim was walking on the tracks in a drunken stupor on his way back from the beer festival, when he was struck by a train from the S2 line between the stops at Laim and Moosbach.

The Australian was heading back to a camping site at Obermenzing with a 25-year-old man from New Zealand, but because the two antipodeans had just met, his companion could not provide authorities with any information about the victim.

“The two men apparently did not see the approaching S-Bahn before one of them was hit by the engine and fatally injured,” the police said in a statement.

The man from New Zealand was uninjured in the accident, but was treated for shock.

Is the driver of the S-Bahn 50% responsible for this accident? S/he should have known the Oktoberfest was going on and that there could be idiots walking on the tracks. If I was the woman that was 50% responsible for hitting the pedestrian, I would go to court raising he77 about this now.

I agree since she was in full respect to the law. She was below the posted speed and did what she could to avoid the accident.

My thoughts are with the S-Bahn driver who is most likely going to come out of this highly traumitized. They should share zero responsibility for this accident, which was a result of pure stupidity on the pedestrians part - if you stick your hand in fire, you will get burned!

As reported by TheLocal only last week, a court recently ruled that a motorcylcist who killed a drunk pedestrian was partly to blame because she should have expected party goeres to be wandering about - http://www.thelocal.de/society/20090915-21927.html

So should the S-Bahn driver should be treated much differently? Perhaps, afterall it is easier to swerve/brake and avoid an accident riding a motorcylce than when driving a train.
